Poland is ordered to pay the European Commission a daily penalty payment in an amount of €1 000 000

Compliance with the interim measures ordered on 14 July 2021 is necessary in order to avoid serious and irreparable harm to the legal order of the European Union and to the values on which that Union is founded, in particular that of the rule of law.

By its judgment of 19 November 2019, the Court of Justice, questioned by the Sąd Najwyższy – Izba Pracy i Ubezpieczeń Społecznych (Supreme Court (Labour and Social Insurance Chamber), Poland) held, inter alia, that EU law precludes cases concerning the application of EU law from falling within the exclusive jurisdiction of a court which is neither an independent nor an impartial tribunal. Subsequently, ruling on the disputes which had given rise to its request for a preliminary ruling, the Sąd Najwyższy – Izba Pracy i Ubezpieczeń Społecznych, in its judgments of 5 December 2019 and of 15 January 2020, held in particular that the Izba Dyscyplinarna (Disciplinary Chamber, Poland) of the Sąd Najwyższy (Supreme Court, Poland) cannot, having regard to the circumstances in which it was formed, the extent of its powers, the composition of that chamber and the involvement of the Krajowa Rada Sądownictwa (National Council of the Judiciary, Poland) in its creation, be regarded as a court or tribunal within the meaning of EU or Polish law.

Skupna zunanja in varnostna politika EU: kaj določa člen 42.7 Pogodbe o Evropski uniji

Skupna varnostna in obrambna politika je sestavni del skupne zunanje in varnostne politike. Evropski uniji zagotavlja operativno sposobnost, oprto na civilna in vojaška sredstva, ki jih EU lahko uporablja pri misijah zunaj svojih meja za ohranjanje miru, preprečevanje konfliktov in krepitev mednarodne varnosti v skladu z načeli Ustanovne listine OZN. Za izvajanje teh misij se uporabijo zmogljivosti, ki jih zagotovijo države članice (člen 42.1 PEU).

Predstavništvo Evropske komisije v Sloveniji jutri, 10. novembra 2015, pripravlja dialog z državljani z naslovom TTIP: kaj prinaša prostotrgovinski in naložbeni sporazum med EU in ZDA. Gosta bosta evropska komisarka za trgovino Cecilia Malström in državni sekretar na Ministrstvu za gospodarski razvoj in tehnologijo Aleš Cantarutti.

O mehanizmu civilne zaščite na ravni EU

Ključno vlogo pri koordinaciji ukrepov civilne zaščite na ravni EU ob nesrečah v Evropi in svetu ima Evropska komisija. Mehanizem civilne zaščite EU, v katerem dejavno sodeluje tudi Slovenija, deluje že od leta 2001. Skupnost ima na področju civilne zaščite sicer zgolj podporno vlogo državam članicam EU pri njihovih prizadevanjih za izboljšanje prepečevanja, pripravljenosti in odziva na nesreče. Ob večjih nesrečah, ki presežejo zmogljivosti posameznih držav, pa je vloga EU usklajevanje stikov med zadevno državo, strokovnjaki na terenu in državami, ki sodelujejo v mehanizmu civilne zaščite EU.

Pregled dogajanj v EU – od begunske krize do parlamentarnih selitev

Na vrhu šefov držav in vlad EU v Bruslju so se prejšnji teden uspeli dogovoriti o nadaljnjih ukrepih pri spopadanju z begunsko krizo v Evropi (sodelovanje s Turčijo, povečanje pristojnosti in nalog agencije EU za zunanje meje Frontex). O prihodnosti Velike Britanije v EU niso razpravljali, ker britanski premier Cameron za zdaj še ni predstavil svojih zahtev, zato bodo o tem razpravljali na decembrskem vrhu. Zunanji ministri EU so se odločili, da za štiri mesece zamrznejo sankcije proti predsedniku Belorusije Lukašenku ter 170 drugim osebam in 14 organizacijam. Skupina evropskih poslancev pod vodstvom nekdanje poslanke Strasbourga Catherinne Trautmann, ki se zavzema za dokončno selitev Parlamenta iz Bruslja v Strasbourg, pa naj bi še v tem mesecu predstavila  svoje načrte.

We have all been greatly affected by the unfolding European refugee crisis and the EU’s failure to offer a coherent response. Another EU default, in the same summer as the Greek debt crisis. Most observers will agree that both crises are not just of the EU’s own making, but that does not erase the fact that the policy responses appear wholly inadequate.

In my previous blog I critiqued the rules-based approach of EMU and Eurozone governance. Not that it is bad to have good rules, but for a well-functioning economic and monetary union a mere set of rules on national budgetary discipline is insufficient. Some kind of fiscal transfer mechanism is required. Today I read that a French member of government, Mr Macron, is of the same view.
